In July 2001, the EU Commission published a consultation document which considered options for reform of the different systems of national contract law which exist across the EU. The Committee's report finds that there is a lack of consensus regarding the issue and the extent of additional costs attributable to differences in national contract laws. Problems may be greater in some areas, such as financial services, than in others. Some problems have been created by Community legislation, and these need to be remedied. There is insufficient evidence of the need for a directly applicable European Contract Code at present. The way forward lies in a combination of promoting greater convergence of national laws and improving the quality of existing Community legislation.
